Bewbs are better than a piece of paper.
I have several videotapes of cops crossing the centerline on TN roads. Just follow one with a videocam on any road for 1 mile, and catch them speeding, running stop signs, etc. If their emergency lights and siren are not turned on, they cannot break any of their traffic laws. Constitutional Equal Protection doctrine in 14th Amendment requires that when a govt employee gets to do something, then everyone gets to do it. That's The Law.

I spoke with Oldham today about his recent victory in Blount County courts, for Dragonslayers charged with "drag racing". I asked him how he won those trials.
Tennessee Code §55-10-501. Part definitions
(1) "Drag racing" means:
(A) That use of any motor vehicle for the purpose of ascertaining the maximum speed obtainable by the vehicle;
(B) The use of any motor vehicle for the purpose of ascertaining the highest obtainable speed of the vehicle within a certain distance or within a certain time limit;
(C) The use of any one (1) or more motor vehicles for the purpose of comparing the relative speeds of such vehicle or vehicles, or for comparing the relative speeds of such vehicle or vehicles within a certain distance or within a certain time limit;
(D) The use of one (1) or more motor vehicles in an attempt to outgain, outdistance or to arrive at a given destination simultaneous with or prior to that of any other motor vehicle; or
(E) The use of any motor vehicle for the purpose of the accepting of, or the carrying out of any challenge, made orally, in writing, or otherwise, made or received with reference to the performance abilities of one (1) or more motor vehicles;

Oldham explained that an "Essential Element" of "drag racing" is a prior spoken agreement to "race". This is, of course, impossible for prosecutors to prove. Without this one Essential Element, the charge of "drag racing" must be dismissed. This elelment is required to prove "mens rea", which is "premeditated intent". Statutes to the contrary are Constitutionally "void for vagueness".
Oldham also proved the THP trooper was guilty of perjury and fabrication of evidence. The trooper testified under oath that he RADARed the bikers at 85 mph on the Dragon. This was NOT proven by the police videotape, which is NOT in sync with the RADAR. However, the Blount County deputy testified under oath that the trooper was lying, that the trooper was NOT running RADAR. Thus the trooper simply made up an imaginary RADAR readout. It's virtually impossible to use RADAR on the Dragon, because it's almost impossible to get a RADAR lock. Accuracy is impossible due to trees giving false readings due to "Panning Effect" (the 86 mph tree).
Oldham said he routinely proves police "testilie" on the witness stand in Tennessee courts, and gets judges to ORDER the prosecutors to prosecute those cops for that crime.
THP troopers routinely lie and purjur themselves when suing traffic tickets on the Dragon. A biker tourist on the Dragon got a speeding ticket from a female trooper driving an SUV earlier this year. The trooper refused to let him see the RADAR readout, which indicate there was no RADAR readout, and the speed was imaginary. The US Navy soldier was from out of state, but said if he were located in Tennessee, he would definitely fight that ticket in court.
Oldham was very interested to learn that Tennessee police and state courts do NOT have jurisdiction on the Dragon, thanks to the 11,000-acre land grab by the federal government, in January 2007. This is according Dragon state rep Doug Overbey, attorney at law, and the assistant director of Great Smokey Mountain National Park. The GSMNP boundary runs right down the centerline of the Dragon US 129, starting at the NC state line, and covers both sides of the Dragon in other places. In January 2007, ALCOA Corporation donated 11,000 acres of its Tapaco Wildlife Area to Nature Conservancy Corporation, which donated it to US Park Service. This land grab removed 11,000 acres from state tax revenues for Blount County Municipal Corporation, including property taxes, sales taxes and traffic ticket taxes.

I dunno, a lot of people are ragging on LEO. I was there today running pretty hard and ran up on 2 Blounts sitting at one of the pull offs.
I wasn't driving reckless, but I was driving VERY aggressive. They just looked up at me, then looked back down at what they were doing.
If that had been my home PoPo, they'd have hooked me up for reckless driving. My hat is off to them for, at least in my case, showing some tolerance and patience.

It's guys like Pirate that would die to protect the freedoms that most people don't even know they have--just because it's the right thing to do. My hat is off to him. The tin foil hat thing was a bit out of place here.
While I respect LEOs I've known several in different counties, and they'll tell you that not all LEOs are good anymore. Unfortunately most of them are trained to abuse rights rather than protect and serve.
Because someone else is doing something wrong does not give you the right to break the law. I don't care if the cop was driving 300 miles per hour in the wrong lane with his hair on fire. that does not give the right to break the law.
It's very hard for me to understand why people think it is ok, we teach our children these basic values at an early age.
Some cops are great and some of them suck but you still have to obey the law or pay the price.
Making a bad cop pay the price is a separate issue.
The priate has posted this same crap on so many websites that it is more a cut and paste operation for him/her and frankly is a little paranoid.
@Jeff, The point that Piratenews is trying to make is this, if someone is guilty of committing a crime, they can't press charges against someone else for committing the same crime.
Agreed, it's a weak argument. But it is what it is. Personally, *I* ain't gonna gamble on it.
Oh, LEOs were handing out the invitations today. I got VERY lucky, I slowed for a sweeper and they got the car in front of me. had I been nabbed, I'd have manned up and paid the fine. Got some good video of it too, but I'm exercising my 5th amendment right and not incriminating myself by posting it LOL.
Hey, at least it's a cager getting a ticket and not a bike! Think of it that way! :) He doesn't look unhappy about it!
@Tom, Yeah at least. I don't get it. I'm a cager, I pull over for faster traffic, I don't cross the center line and I damn sure don't drive 15 mph with a parade of traffic behind me.
But I'm sure *I* would be more deserving of a ticket than someone on a bike that didn't drive with the same consideration as me.
What a crock. I've seen horrible driving by all kinds of riders/drivers since I've been here this week.
The "Cager" that was in front of me today that got tagged, she wasn't crossing the centerline, she moved over for a motorcycle. I guess under her circumstances, at least "it was a cager".
You should be a little less pre-judgemental about cagers and perhaps police a the non-cagers a bit. Trust me, from what I've seen this week. Squids ride and drive ALL kinds of wheels.
There are poor drivers/riders in everything. Bikes think cars all are reckless, slow, and cross the center; whereas people who have capable vehicles and can drive fast and responsibly wish all the bikes would pull over so we could actually drive quickly. I've never held up a bike, but they sure as hell hold me up ALL the time.....and bikes seem to think crossing the center is ok if there's a traffic jam. I have pictures and video of tons of bikes being complete tools. Don't worry, I have yelled at some tools in cars too.
Anyone on any vehicle should be ticketed for crossing the center line or specifically endangering someone. OTherwise leave people alone and have a good time.
