Oil Streak culprit. It could happen to anyone, but his partner right behind him could have done something. It caused at least one crash before I could get orange flags up and write OIL in the road with the chalk.

It was my first time to deals gap, and I was a casualty of this oil spill, a tree was the only thing that saved me from going over the hill. Little good that did my bike.... It was totaled the next day in Blue Ridge, GA. I was rearended
Take it easy on 'em...like I said the people in the first truck probably had no idea, but their buddies in the second truck could have reacted somehow...the trail runs the entire length of the Gap. Some people just don't think about the consequences of their (in)actions. We've seen people pull over because there vehicle was leaking antifreeze and overheating. Instead of fixing the leak, they will just wait until it cools, then try to drive some more...no concern for the trail of lubricant they are laying down.
Anyway, I believe these folks pulled into the parking lot down at the store...at least that's where their trail ends up at.
There is a thing called negligence. Whether they intended it or not, people were affected by them.

If this is negligence on the part of the operator of the vehicle, then the insurance policy for the vehicle would probably cover it. The trick would be proving negligence and causation in an individual case. Those Powerstrokes hold 15 quarts of oil and won't shutoff until there's almost none left for the injection system. (I've got one) Fifteen qts will easily oil the Gap. But... if you have witnesses, pictures, and damage, it's probably worth something to at least make a demand on Millsaps and get his carrier involved.
dude no one is going to be able to win such a ridiculous lawsuit. I agree that if I were one of the riders to go down then I'd try to do something but the fact of the matter is there's no way to PROVE by law that the oil is what caused you to go down. Especially since not every single person went down on it. If you had been going the speed limit then you might not have slipped, etc etc... You'll never win it. Plus while he is responsible for the vehicle, unless he knew he was leaking and out of negligence continued on then he can't be held at fault. Plus like Lex said this was hardware failure. Cars leak oil all the time. You do what you can be the lawsuit would be technically against the hardware. Give it a rest guys. I feel for you but you're not going to be able to do anything about it especially since such a lawsuit would be the same as suing the NCDOT for there being gravel on some turns....
you'll never be able to prove it though. and dropping oil from a motor isn't an issue. the dot is supposed to clean it up. you're basically treating it like a big rig who's tanker leaked. that's not the way it works though.
Who said anyone was speeding? You can easily crash in oil at very low speeds...hell 2 people crashed at 5mph today in front of me in gravel.
